Every single one of the non-electronic parts of the Danze faucets are warranted to the original consumer purchaser in order to be free from defects in material and workmanship, for as long as the original consumer purchaser owns it. Also, each and every electronic part of the Danze faucets are warranted to the original consumer purchaser to be free from defects in material and workmanship for a period of not less than five years. However, batteries are not included in the warranty. If any of the product's parts are proven to be defective in material or workmanship under the application of a normal residency, then Danze will replace the product for you.

If there is an impractical aspect in the replacement of the original part of any of the products, Danze may decide to replace them/it using an equivalent part. Danze can also refund you for the purchase price in exchange for them taking back the product.

With the warranty also come remedies that are exclusive to Danze. Avoid abrasive cleaners at all costs; steel wool should be avoided too as well as any harsh chemicals. All of these cleaners end up dulling the finish on the Danze faucets and eventually voiding your warranty.

It is important to note; THIS WARRANTY IS LIMITED TO REPLACEMENT PARTS ONLY AND DOES NOT AT ANY POINT COVER OR INCLUDE LABOR CHARGES OR DAMAGE INCURRED DURING THE INSTALLATION PROCESS, REPAIR OR REPLACEMENT OR ANY INCIDENTAL AND/OR CONSEQUENTIAL DAMAGES WHATSOEVER, NOR DOES IT COVER OR INCLUDE DAMAGES FOR PERSONAL INJURY, PROPERTY DAMAGE OR ECONOMIC LOSS. AT NO PARTICULAR POINT IN TIME SHALL LIABILITY EXCEED THE PURCHASE PRICE OF THE DANZE FAUCET. WARRANTY PARTS ORDERS MAY BE SUBJECT TO SHIPPING & HANDLING CHARGES.

This warranty also excludes all the industrial, commercial, and business usage, whose purchasers are hereby extended a five year limited warranty for all the parts that are non-electronic and a one year limited warranty for those parts that are electronic from the date of purchase, with all other terms of this warranty applying except the duration of the warranty. This warranty also excludes installation outside the U.S, Canada or Mexico (North America). The purchasers from this areas are extended a one (1) year limited warranty from the date of purchase, with all other terms of this warranty applying except the duration of the warranty. Any forms of damage to this faucet as a result of improper installation, misuse, accident, neglect or any use that violates the instructions furnished by Danze and as a result, the company WILL VOID WARRANTY IMMEDIATELY without hesitation.

It is important to note also, the warranty is valid only to the original consumer purchaser and it excludes industrial, commercial or business use of any of the Danze faucets. Some states/provinces however, do not allow limitations of how long an implied warranty lasts or the exclusion or limitation of such damages. Therefore, these limitations and exclusions may not be applicable to you. This particular warranty gives the consumer specific legal rights. Customer Service: USA: 866-538-5536 Canada: 866-884-8841 Technical Support: 1-888-648-6466 Danze by Gerber INTERNET MINIMUM ADVERTISED PRICE POLICY Revised Effective May 1, 2019 INTRODUCTION This Policy replaces and supersedes all prior Internet Minimum Advertised Price policies (“IMAP” or “Policy”) issued by Danze by Gerber, fka Danze, Inc., (“Danze”) and applies to all Danze distributors, wholesalers, retailers, dealers and other resellers located in the United States (collectively, the “Resellers”). The Policy has been implemented so that Danze can compete better in the market for premium plumbing fixtures, faucets, Danze showerheads and bath accessories. In particular, Danze has determined that adoption of this Policy is a necessary component of its strategy in order to reduce or minimize the channels of distribution conflicts and to ensure that it is in fact Danze by Gerber line of products. It is also supported by aggressive marketing, prominent merchandising and product displays, pre-sale and post-sale customer service, education and stocking of sufficient product inventories to adequately service the local market. The Policy is subject to change at any time by Danze, in its absolute discretion.

POLICY APPLICATION

This Policy applies to all Resellers of Danze by Gerber® products particularly those who buy directly from Danze and who now or hereafter directly sell Danze by Gerber® products on the internet or who resell any Danze by Gerber® products (the “Covered Products”) to one or more companies operating an internet website on which they intend to sell, the Covered Products. POLICY The Internet Minimum Advertised Price (“IMAP”) for a Covered Product is 30% off the then current standard list price published by Danze for the Covered Products. The policy is unilateral, non-negotiable and will not at any point be altered for any Reseller. Each Reseller is free to decide on their own, whether or not to follow the Policy. All Resellers of Covered Products are absolutely free to sell the Covered Products at any price of their choosing and at their discretion.

The Policy applies to all SKUs manufactured and distributed by and in the name of Danze by Gerber® brand name that is set at danze.com, which Resellers have to review on a regular basis. The policy however, does not apply to any of the discontinued, closeout or distressed merchandise, or to any of the special over-stock promotions as announced by Danze.

From time to time, Danze may announce promotional periods during which the Policy will not apply with respect to all or some of the covered products.

VIOLATIONS

When a price for a Covered Product is displayed on any internet site that is below the published IMAP price, this implies that there is “Violation” of the “Minimum Internet Advertised Price Policy”. It also includes using any online or internet advertisements or campaigns with respect to the sale of Covered Products as well as any sponsored links and websites operated by, affiliated with, or linked to the Internet Reseller’s website(s). The definition of price is not inclusive of any price discounts displayed after a product is added to the cart. If by any chance after making an investigation into any alleged or discovered violation Danze determines to its sole satisfaction that a Reseller may have directly or indirectly through third parties, engaged in Internet Advertising of any Covered Products at a resale price that is lesser than the IMAP price.

Danze may take the following actions in such a case: the seller will be notified first by Danze in writing of any of the violations of the IMAP policy. If the Reseller corrects the violation within fifteen calendar days, then no further action will be required. If the reseller does not correct the violation within those fifteen days, the reseller will be notified of the suspension of sales of the covered products by Danze. The violation should be related for a minimum of about thirty days.

In the event that the reseller continues to be in violation of the IMAP policy, the reseller will definitely be notified by Danze as well as Danze’s suspension of sales of all the covered products to the reseller for a minimum of six months.

It is important to note: the intention of the formulation of the policy is not to restrict Danze’s rights to managing the distribution channels as well as to make changes to the decisions regarding the resellers and others who will do business with them. The number of violations and the response of the reseller when advised of a violation aspect of this IMAP, Danze may bypass all the steps indicated above and cease doing business with the reseller.

DANZE BY GERBER IMAP POLICY ADMINISTRATION

The authority to modify, alter, negotiate or make agreements with respect to the policy to any reseller is not at all given to any of the Danze employees or the sales representative. The only person who is authorized to answer questions that pertain to the Policy or to comment on the Policy on behalf of Danze, and the person to whom all questions pertaining the Policy must be addressed, is the Danze IMAP Policy Administrator.
